Seafarr Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you", "your") and Depzilla Corp. ("Seafarr", "we", "us", "our"), which operates the Seafarr mobile app and website at https://seafarr.net (together, the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.


1. What Seafarr is — and is not

Seafarr is a platform that helps seafarers build a professional profile, store and organize maritime credentials, run assistive document checks, and — at your choice — share their profile and availability with manning agencies and shipping principals.

Seafarr is not a manning agency, crewing agent, recruiter, or employer. We do not hire seafarers, do not act as a party to any employment or crewing contract, and do not guarantee that you will be contacted, shortlisted, hired, or deployed. Any engagement you enter into is solely between you and the relevant agency, principal, or employer.


2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for working seafarers and the agencies and principals who recruit them. By using the Service you represent that you meet these requirements and that the information you provide is true and accurate.


3. Your account

  • You are responsible for the accuracy of the information you provide and for keeping it up to date.
  • You are responsible for safeguarding your login credentials and for all activity under your account.
  • You may sign in with email/password or, if you choose, with Google or Facebook.
  • Notify us promptly at support@depzilla.com if you suspect unauthorized use of your account.

4. Your content and documents

You retain ownership of the personal information, documents, certificates, and other content you upload ("Your Content").

By uploading Your Content, you grant Seafarr a non-exclusive, worldwide license to host, store, process, display, and transmit it solely to operate and provide the Service — including running assistive document checks (see Section 6) and sharing Your Content with agencies and principals where you have enabled that sharing. This license ends when you delete the content or your account, except for content already shared with third parties and copies we must retain by law (see the Privacy Policy).

You represent that you have the right to upload Your Content and that it does not infringe anyone's rights or contain unlawful material. You are responsible for the accuracy and authenticity of every credential and document you upload.


5. Acceptable use

You agree not to:

  • Upload false, forged, fraudulent, or misleading documents or credentials;
  • Impersonate any person or misrepresent your identity, rank, or qualifications;
  • Upload another person's personal data without authority, or violate anyone's privacy;
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems;
  • Interfere with, disrupt, reverse-engineer, scrape, or overload the Service;
  • Use the Service for any unlawful purpose or in violation of these Terms or applicable law.

We may suspend or terminate accounts that violate this Section, and may report suspected document fraud as permitted by law.


6. AI-assisted document checks (assistive only)

The Service uses artificial intelligence (Google Vertex AI) to read, summarize, and assess the authenticity and fit of uploaded documents. These checks are assistive and informational only. They are not an official verification, certification, or endorsement of any credential, and they do not replace verification by the issuing authority, flag state, agency, or principal. A "verified" status in the app does not guarantee a document is genuine or currently valid. You and any recipient remain responsible for independent verification. 7. Sharing with agencies and principals

When you enable sharing, agencies and principals you authorize may view your profile, credentials, and availability. Once they receive your data, they act as independent controllers under their own terms and privacy notices. Seafarr does not control, and is not responsible for, how third parties use information you choose to share with them. You can change your sharing settings at any time, though we cannot recall data already received by a third party.


8. Subscriptions, billing, and cancellations

  • The Service offers a free tier and paid subscription(s) (e.g. "Pro").
  • Purchases are processed by the Apple App Store and Google Play (managed via RevenueCat). We do not collect or store your card or payment-method details.
  • Paid subscriptions auto-renew unless you cancel at least 24 hours before the end of the current period, in line with the app store's rules. Your store account is charged for renewal within 24 hours before each period ends.
  • Manage or cancel your subscription through your Apple App Store or Google Play account settings. Deleting the app does not cancel a subscription.
  • Refunds are handled by Apple or Google under their respective policies; we generally cannot issue refunds directly for store-processed purchases.
  • Prices and plan features may change; we will give notice as required, and changes do not apply retroactively to a period you have already paid for.

9. Intellectual property

The Service — including its software, design, text, graphics, and logos (excluding Your Content) — is owned by Seafarr or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service except as permitted by law.


10. Third-party services

The Service relies on third parties (e.g. Supabase, Google Cloud / Vertex AI, RevenueCat, Apple, Google, Facebook, CARTO, Resend). Your use of features provided through them may be subject to their terms. We are not responsible for third-party services or content.


11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, that document checks will be accurate, or that using Seafarr will result in employment or deployment. You use the Service at your own risk, to the fullest extent permitted by law.


12. Limitation of liability

To the fullest extent permitted by law, Seafarr and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or employment opportunity, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.


13. Indemnification

You agree to indemnify and hold harmless Seafarr from any claims, damages, liabilities, and expenses arising from Your Content, your use of the Service, or your breach of these Terms or of any law or third-party right.


14. Suspension and termination

You may stop using the Service and delete your account at any time (see Account & Data Deletion). We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Some provisions — including Sections 4 (final sentence), 9, 11, 12, 13, and 17 — survive termination.


15. Apple App Store and Google Play terms

If you obtained the app from the Apple App Store: these Terms are between you and Seafarr only, not Apple; Apple has no obligation to provide support or maintenance for the app; Apple is not responsible for any product warranties or claims relating to the app; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You confirm you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and are not on any U.S. restricted party list. Similar conditions apply where the app is obtained from Google Play.


16. Changes to these Terms

We may update these Terms from time to time. When changes are material, we will update the "Last updated" date and, where appropriate, notify you in the app. Continued use of the Service after an update means you accept the revised Terms.


17. Governing law and disputes

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of- law rules. You and Seafarr agree to submit to the exclusive jurisdiction of the courts of Minglanilla, Cebu, Philippines, except where applicable consumer-protection law gives you the right to bring proceedings elsewhere.
